1. The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent to issue him appointment letter for the post of Junior Engineer (Electrical) as per final result dated 17.10.2024.
2. The petitioner pursuant to advertisement applied for the post of Junior Engineer (Electrical). As per prescribed qualification in the advertisement, a candidate was required to have Bachelor degree in Electrical/Electrical & Electronics Engineering with a minimum 60% marks. The petitioner has secured B.Tech degree with 59.56% marks. The respondent-Haryana Staff Selection Commission recommended petitioner’s name though names of many candidates were rejected on Shivani Gupta 2025.07.01 17:52 I attest to the accuracy and integrity of this document

the ground of absence of minimum 60% marks in Bachelor’s degree. The name of petitioner figured in the list of recommended candidates.

Mr. Prince Singh, Advocate, who on advance notice is present in Court, submits that the respondent vide communication dated 27.11.2024 has requested Haryana Staff Selection Commission to issue necessary clarification. It is not clear whether 59.56% marks can be considered equivalent to 60% marks.
4. Ms. Rajni Gupta, Addl. A.G., Haryana, appearing on behalf of Haryana Staff Selection Commission submits that Commission had already recommended name of petitioner nevertheless if directed by this Court, the respondent would clarify its position by way of appropriate reply to communication dated 27.11.2024 of intending department.
5. Without commenting on merit and considering stand of contesting parties, this Court finds it appropriate to direct Secretary, Haryana Staff Selection Commission, Panchkula to clarify as to whether 59.56% marks obtained in B.Tech degree may be considered equivalent to 60%.
6. Let the needful be done within 2 weeks from today.
