JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.7 under Section 439 of Code of Criminal Procedure, praying to grant bail in S.C.no.1634/2017 (Crime No.259/2017 of Rajagopal Police Station) registered for offences punishable under Sections 399 and 402 of Indian Penal Code, pending on the file of LXVI Additional City Civil and Sessions Judge, Bengaluru. (CCH-67). - 3 - HC-KAR NC: 2025:KHC:54436 CRL.P No. 13705 of 2025 2. Heard learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State. 3. The petitioner who is accused No.7 in Crime No.259/2017 of Rajagopal Nagar Police Station, registered for offences punishable under Sections 399 and 402 of IPC has been granted bail and released on bail on 27.09.2019. Thereafter, the charge sheet has been filed and the case has been committed to the Sessions Court and it is pending S.C.No.1634/2017. After grant of bail, the petitioner appeared before the Sessions Court on some dates and subsequently, he remained absent. The petitioner has been secured by executing NBW issued against him on 25.08.2025 and he is in judicial custody since then. It is admitted that, due to loss of communication between the petitioner and his counsel, he could not appear in the said case. The petitioner is now ready to deposit Rs.50,000/- towards forfeited bond amount. In that regard, the learned counsel for petitioner - 4 - HC-KAR NC: 2025:KHC:54436 CRL.P No. 13705 of 2025 has kept Demand Draft for Rs.50,000/- dated 10.12.2025 ready and it is drawn in the name of Registrar, City Civil Court, Bangalore on Karnataka Bank Ltd. The learned counsel for petitioner submits that, he will submit this Demand Draft before the trial Court within two days. The trial Court has to receive the said Demand Draft and issue receipt. The petitioner has undertaken to appear before the trial Court on all dates of hearing unless exempted by the trial Court and co-operate for speedy disposal of the case 4. Considering all the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following; ORDER The Criminal Petition is allowed. The petitioner is granted bail in S.C.no.1634/2017 (Crime No.259/2017 of Rajagopal Police Station) pending on the file of Additional LXVI City Civil and Sessions Judge, Bengaluru. (CCH-67), subject to following conditions: - 5 - HC-KAR NC: 2025:KHC:54436 CRL.P No. 13705 of 2025 i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the trial Court. ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case. iv) The petitioner shall furnish the receipt for having deposited Rs.50,000/- towards forfeited bond amount.
