In pursuant to the order passed on 21.04.2025, by a co-ordinate bench of this Court, Sri Sub-Inspector Palash Bora, the Investigating Officer of Karimganj Police Station Case No. 42/2025 has personally appeared before this Court and has explained the reasons for which the Case Diary could not be sent on earlier occasions. He stated that though the Case Diary was not sent, however, he had sent a W.T. Message on 28.02.2025 through the Office of the learned Additional Public Prosecutor intimating the reasons for not sending the Case Diary, i.e. the charge sheet was already been laid by that time. The explanation given by the Investigating Officer is acceptable. 3. As the learned Senior Counsel for the petitioner has submitted that as charge sheet has already been filed and as the petitioner is on interim bail granted by this Court, by order dated 12.02.2025, and he has not violated any of the conditions, of the interim bail, his interim bail may be allowed. He prays that he may be allowed to continue till the appearance of the petitioner before the Trial Court. 4.
Considering the fact that the charge sheet has already been laid vide charge sheet No. 45/2025 dated 26.02.2025 in this case, the interim anticipatory bail granted to the present petitioner by order dated 12.02.2025, shall continue till for next three months or till the issuance of summons and the appearance of the petitioner before the Trial Court whichever is earlier, subject to the condition that the petitioner shall not directly or indirectly make any inducement, threat or promise to the victim girl or to any other family persons or any other persons who may be
Page No.# 3/3 acquainted with the facts of the case so as to dissuade such person from disclosing such facts in the trial before the Trial Court. 5. The communication submitted by the Investigating Officer before the Court today shall be kept as a part of the record. 6. This anticipatory bail application is accordingly disposed of.
