Mr. Pantu Deb Roy, Ld. AGP Mr. Pannalal Bandopadhyay. 1. Affidavit-of-service, filed by the learned counsel for the petitioners in Court today, is taken on record. 2. Heard the parties through their respective counsels. 3. The petitioners in the instant case are lawful registered owners of the operation of the autorickshaws and are holding Permanent Contract Carriage Permit in the Route No. 316, issued by the respondent no.2. 4. The grievances of the petitioners are with regard to unauthorized plying of autorickshaws in the Route Sinthee More to Dum Dum Station via 30A Bus Stand and unlawful registration of the autorickshaws in absence of any valid document including offer letter. 5. The petitioners submits that already a complaint has been lodged with the respondent authorities with regard to such unauthorized plying of autorickshaws in
2 the route in question. Till date the complaint has not been redressed by the respondent authorities. 6. From the document dated 21.3.2025 at page 46 to the writ petition it appears that the respondent no.2 has informed in writing to the Sub-Divisional Officer Barrackpore, North 24 Parganas with regard to the complaint against unauthorized plying of autorickshaws in the route in question that they have been able to find 12 numbers of autorickshaws to have the offer letters out of 62 numbers of autorickshaws. 7. Having heard the parties and perusing the materials available on record I direct the Sub-Divisional Officer, Barrackpore, North 24 Parganas with the assistance of the Secretary of the respondent no.3 to consider the complaint by making an independent inquiry and investigate into such affairs of unauthorized plying of autorickshaws in the route in question. 8. The Sub-Divisional Officer, Barrackpore, North 24 Parganas shall arrive at a logical conclusion upon affording an opportunity of hearing to the interested parties and pass a reasoned order in accordance with law. 9. The Sub-Divisional Officer shall complete the entire exercise within a period of sixty (60) days from the date of communication of this order. 10.
However, it is made clear that if any irregularity and/or illegality is found, the authority concerned shall
3 forthwith take appropriate steps in accordance with law. 11. Accordingly, the writ petition stands disposed of without expressing any opinion on the merits of the case. 12. There will be no order as to costs. 13. Parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Smita Das De, J.)
