Order No.02 Dated- 17-03-2025 Heard the parties.
Apprehending their arrest in connection with Shyamsundarpur P.S. Case No. 02 of 2025 instituted for the offences punishable under Sections 303 (2), 317(5) of BNS, Rules 4/21 of MMDR Act, Section 4/54 of Mines & Minerals Act & Sections 7/9/13 of Jharkhand Minerals (Prevention Illegal Mining Transportation & Storage ) Rules, 2017, the petitioners have moved this Court for grant of privileges of anticipatory bail.
Learned counsel appearing for the petitioners submits that the allegation against the petitioners is that the petitioner no.1 is the driver of seized Hywa bearing Registration No. JH-05CG/3353 and petitioner no.2 is the owner of the said vehicle which was seized by police while being involved in transportation of illegally excavated sand. It is submitted that the allegation against the petitioners is false. Drawing attention of this Court towards para-13 of the instant bail application, learned counsel for the petitioners submits that the petitioners have no criminal antecedent. Hence, it is submitted that the petitioners be given the privileges of anticipatory bail.
Learned Spl. P.P appearing for the State opposes the prayer for anticipatory bail of the petitioners.
