In compliance with the order dated 13.02.2025, an affidavit of the Assistant Consolidation Officer, Shahganj, Jaunpur has been filed, where it is averred in paragraph nos. 4 to 7: "4. That the deponent has taken charge of Assistant Consolidation Officer only on 07.01.2025 in compliance of posting order dated 03.01.2025 passed by the District Magistrate, Jaunpur. 5. That petitioner has given an application to the Settlement Officer of Consolidation by hand on 19.11.2024 and upon the application Settlement Officer of Consolidation directed the Consolidation Officer/Assistance Consolidation Officer to measure the Chak No. 553 Gata No. 1409, Area 0.21 Dismal, situated at Village Manikala, Pargana Anguli Tehsil Shahgnaj, District Jaunpur. 6. That deponent has measured aforesaid land of the petitioner on 20.02.2025 in presence of petitioner and other Co-tenure holder. A true copy of spot memo report dated 20.02.2025 in presence of petitioner and Police Personnel is being filed herewith and marked as Annexure No. 1 to this personal affidavit. 7. That deponent has complied the order dated 13.02.2025 passed by this Hon'ble Court and order dated 19.11.2024 passed by the Settlement Officer of Consolidation in its pith and substance in accordance with law and petitioner is satisfied with the measurement and signed upon the spot memo." 2. Annexed to the affidavit at page 7 of the aforesaid affidavit is a memo dated 20.02.2025 regarding the fact of demarcation and affixation of boundary marks signed by the petitioner and the other parties involved, all done in the presence of the police. The spot memo, regarding the affixation of boundary marks, is signed by the Assistant Consolidation Officer, Shahganj, Jaunpur. The contents of the spot memo read: "स्पपाट ममेमम पपूररसपूचनपा आज ददिनपानांक 20/02/2005 कम गपाम मपाननी कलपा परगनपा अनांगगुलनी तहसनील शपाहगनांज जजलपा जजौनपगुर मम मपानननीय उच्च न्यपायपालय ररट यपादचकपा सनां 94/2025 मम० उमर बनपाम स्टमेट आफ उत्तर प्रदिमेश र अन्य कमे सम्बन्ध मम चक सनांख्यपा 553 कम गपाटपा सनां० 1409 ककी पपैमपाइश पगुजलस बल र पक एरम दरपक ककी उपसस्स्थिदत मम सनीमपानांकन दकयपा गयपा र स्स्थिल पर दचसन्हत दकयपा गयपा। मजौकमे पर उपसस्स्थित यपाचनी कतपार नमे अपनपा हस्तपाकर बनपायपा एरम दरपकनी अपनपा हस्तपाकर करनमे समे इनकपार दकयपा।" 3. In this view of the matter, no cause of action survives in this petition. It is, accordingly, consigned to record.
