Neutral Citation No. - 2025:AHC:133474 Court No. - 5 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 23267 of 2025 Applicant :- Akash Chaudhary Opposite Party :- State Of U.P. And 3 Others Counsel for Applicant :- Ravindra Pratap Singh,Vishal Singh Counsel for Opposite Party :- G.A. Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Shri Vishal Singh, learned counsel for the applicant and Shri B.P. Singh, learned A.G.A..
2. This is the second bail application on behalf of the applicant. The first bail application of the applicant was rejected by a reasoned order dated 29.04.2024. The applicant is facing trial for an offence of gang rape of a minor girl aged about 8 years.
3. I have perused the status report of the trial court dated 25.07.2025 that out of the 10 proposed witnesses, three have been examined including the victim.
4. Learned counsel for the applicant has referred to the statement of the victim that victim as well as her mother that it may be a case of false implication.
5. However, I find merit in the argument of learned A.G.A., who submits that the age of the victim is nine years and she remained very consistent in her testimony against the applicant as well as nothing adverse is reflected in her cross-examination. Therefore, the Court is of the opinion that considering the nature of the offence as well as considering the victim's age which is about eight years at the time when occurrence took place as well as her statement against the applicant, no case for bail is made out.
6. Accordingly, the bail application is rejected. Order Date :- 6.8.2025 A. V. Singh Digitally signed by :- AJAY VIKRAM SINGH High Court of Judicature at Allahabad
