[2025:RJ-JP:10983] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2531/2025 Rakesh Bansal S/o Shri Shashikant Bansal, Aged About 35 Years, R/o 31/24/3, Swarn Path, Mansarovar, Police Station Mansarovar, Jaipur (South), Jaipur. (Presently Confined In Central Jail, Jaipur (Rajasthan). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Deepak Sharma For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 11/03/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 593/2024 registered at Police Station Mahesh Nagar, District Jaipur City (South) for the offence(s) under Sections 8/22 of NDPS Act. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. Other co- accused persons were also present with the present petitioner and they have been enlarged on bail by this court vide order dated 27.02.2025. The accused petitioner is in custody since 12.12.2024 and the trial of the case will take considerable time. There is no criminal antecedents against the petitioner, therefore, the benefit of bail may be granted to the accused-petitioner. [2025:RJ-JP:10983] (2 of 2) [CRLMB-2531/2025] Per contra, learned Public Prosecutor opposes the bail application and contended that on personal search of the petitioner contraband articles containing weight of 187 gram of MDMA was recovered from present petitioner’s possession. Said quantity falls within the ambit of commercial quantity, therefore considering the conditions enshrined under Section 37 of the NDPS Act, instant bail application of the accused petitioner deserves to be dismissed. Heard and perused the material available on the record. Considering the fact that on personal search of the petitioner contraband articles containing MDMA 187 grams was recovered from petitioner’s possession, such quantity falls within the ambit of commercial quantity as the commercial quantity of MDMA is 10 grams, therefore, this court is not inclined to enlarge the accused- petitioner on bail. Accordingly, instant bail application is dismissed. (PRAVEER BHATNAGAR),J ashu /6
