ORAL ORDER Sri.Manohar., counsel on behalf of Sri.Nagaraja.S., for the petitioner and Sri.H.V.Devaraju., counsel on behalf of Smt.Anusha Prasad., for the respondent have appeared in person. 2. The captioned Writ Petition is filed seeking a Writ of Mandamus directing the respondent to provide electricity connection to the house of the petitioner. 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care. 4. It is said that the petitioner is a tenant of a house bearing No.67, Ground Floor, 7th Cross, Ambedkar Nagar, 5th Main Road, Srirampuram, Bangalore. The petitioner contends that at the time of occupation of the premises by him, there was no power connection, hence he had requested the authority concerned for power supply and thereafter, he has obtained the electricity connection and he has been paying the regular consumption charges as of today. Based on a complaint given by Sri.Anniyappan., the authority issued a communication

to the petitioner on 19.04.2024 directing him to give a reply and to furnish certain documents. Accordingly, the petitioner gave a reply on 04.05.2024. Counsel Sri.H.V.Devaraju., submits that if a direction is issued, the authority would consider the reply that is submitted by the petitioner in accordance with the law. The oral submission made by counsel Sri.H.V.Devaraju., is placed on record. Admittedly, the petitioner has submitted his reply on 04.05.2024 and the same has not been considered as of today.
Therefore, this court deems it appropriate to direct the authority concerned to consider the reply submitted by the petitioner and to act in accordance with law. By an interim order dated 30.08.2024, the power connection was restored to petitioner's house. The BESCOM Authority is directed not to take coercive steps to disconnect the power supply till the consideration of the reply submitted by the petitioner. Needless to observe the petitioner shall pay the regular consumption charges. 5. Resultantly, the Writ Petition is disposed of. - 4 -
