1. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The learned counsel appearing on behalf of the petitioners, at the outset, seeks permission to withdraw the anticipatory bail application with respect to petitioner nos. 2 and

Patna High Court CR. MISC. No.58843 of 2025(2) dt.10-09-2025 2/3 4 only. 5. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 115(3), 109, 352 and 351(2) of the BNS,

Learned counsel for the petitioners next submits that petitioner nos. 1, 3 and 5 are persons with clean antecedent and the informant alleges that on account of dispute amongst children while playing, the accused persons cane and Md. Izrail assaulted the informant by an iron rod causing injury on head, while Md. Sukru assaulted him by an iron knuckle over his body causing injury, thereafter the informant was taken to hospital. 7. Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that on account of dispute amongst children while playing, the occurrence is alleged to have taken place. It is further submitted that both sides assaulted each other.
It is next submitted that no specific allegation of assault is alleged against the petitioners and Md. Izrail is not a petitioner in the instant anticipatory bail application. 8. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sultanganj P.S. Case No. 129 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS. 10. Accordingly, the instant anticipatory bail application is allowed. Rishabh/- (Satyavrat Verma, J) U T
