This application for grant of anticipatory bail, arises out of Manjhi Police Station Case No. 202 of 2025, disclosing offences under Sections 30(a) of Bihar Prohibition and Excise Act. The prosecution case, as per the First Information Report, is that on 07.06.2025, the informant received information from the SHO that three persons had stored illicit liquor in the hutment of one Mahesh Sah in village Gairatpur. Acting on this information, the police party proceeded towards village Gairatpur, whereupon three persons, on seeing the police started feeling away and succeeded in the same. They were identified by the local chowkidar as the petitioners and co-accused. On search of the said hutment, total 36.670 litres of foreign liquor was recovered, concealed/hide under straw. 4. Learned Counsel for the petitioners submit that petitioners have falsely been implicated in the present case. Learned counsel further submits that the alleged recovery has been made from the hutment of one Mahesh Sah and accordingly the said hutment does not belong to the petitioners.
Learned counsel next submits that the name of the petitioners have surfaced in this case on the basis of their identification made by local Chaukidar. Learned counsel further submits that nothing has been recovered from the conscious possession or premises of the petitioners. 5. Having regard to the submissions made by the parties and taking into consideration the fact that nothing has been recovered from the conscious possession or premises of the petitioners, I am inclined to grant the petitioners privilege of anticipatory bail. 6. 7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-2, Saran at Chapra, in connection with Manjhi Police Station Case No. 202 of 2025, subject to the condition laid down under Section 482 (2) of the B.N.S.S.
