Petitioner has been made an accused in connection with S.T. Case No. 355/2023, arising out of Barharwa P.S. Case No. 137/2023, Corresponding to G. R. Case No. 629/2023 registered under Sections 147/ 148/ 149/ 109/ 323/ 341/ 325/302 of the Indian Penal Code, charge has been framed under sections 147/ 148/ 149/ 323/ 341/ 325/302 of the Indian Penal Code, pending in the Court of learned Additional Sessions Judge-I, Rajmahal. Bail application of the petitioner was earlier rejected by this court vide B.A. No. 218 of 2024 by order dated 25.04.2024. The petitioner along with the co-accused persons entered into the house of the informant. There is specific allegation that the petitioner had assaulted the son of the informant, namely Arbind Ramani due to which he succumbed to his injuries. Learned lawyer for the petitioner submitted that the petitioner was also injured in the said occurrence. Learned A.P.P. has opposed the prayer for bail and submitted that the petitioner and the co-accused were aggressor who had gone to the house of the informant when the occurrence had taken place. Regard being had to the facts and circumstance of the case and considering the fact that there is direct allegation against the petitioner, to have assaulted the deceased which resulted in his death; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected. Learned court below shall expedite the trial. (Ambuj Nath, J.) Saurabh uploaded
