This application under Section 528 read with Section 438 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the petitioner, namely, Shantashree Das Choudhury Roy, who is aggrieved by the order dated 03.08.2024 and subsequent orders, passed by the learned Chief Judicial Magistrate, Kamrup(M) in C.R. Case No. 617/2022, whereby, non- bailable warrant of arrest has been issued against the present petitioner. 3. The learned counsel appearing for the petitioner has submitted that the petitioner is facing a trial under Section 138 of the N.I. Act, in C.R. Case No. 617/2022, wherein, she had appeared and was granted bail by the Trial Court. However, due to miscommunication of the engaged counsel, she defaulted to appear on 3(three) consecutive days and on subsequent dates, due to which the non-bailable warrant of arrest have been issued against her. 4. The learned counsel appearing for the petitioner has submitted that the next date of N.I. Case No. 617/2022 is fixed on 07.04.2025 and the petitioner is ready and willing to face the trial, however, she is seeking some interim protection, so that, she can appear before the Trial Court. 5. Considering the submissions made by the learned counsel for the petitioner, the notice to the respondent is waived and as the petitioner is ready to face the trial, this criminal petition is disposed of with a direction to the petitioner to appear before the Trial Court on the next date fixed in N.I. Case No. 617/2022, i.e. on 07.04.2025. 6. To facilitate her appearance before the Trial Court, the operation of non-bailable warrant of arrest issued against her by the Trial Court shall Page No.# 3/3 remain suspended till the said date. 7.
