JUDGMENT: (per Hon’ble The Chief Justice Sri G. Narendar)
We have heard learned Senior Counsel for the petitioners.
2. On perusal of the cause-title, it is seen that the petitioner nos. 1 and 2 are residents of Uttarakhand. Petitioner nos. 3 and 4 are residents of Uttar Pradesh. Respondent no. 2 is S.S.P, District Rohtak, Haryana. Respondent no. 3 is S.H.O. P.S. Rohtak, Haryana and respondent nos. 4 and 5 are residents of Haryana.
3. Allegation, in a nutshell, is that the 4th respondent is the eldest son of the corpus and is preventing the mother 1
2025:UHC:4487-DB (corpus) from meeting and interacting with the other children (petitioners).
4. Though, maintainability is not in question, yet keeping in view the advanced age of the corpus and the fact that the corpus and the 4th respondent and the other answering respondents are in the State of Haryana, it would be appropriate if the petitioners move the High Court of Punjab and Haryana as High Court of Punjab and Haryana would be more suitable placed to effectively and efficaciously deal with the matter without loss of time.
5. In that view, we dispose of the writ petition with liberty to the petitioners to approach the High Court of Punjab and Haryana on the same cause of action.
6. Petition stands disposed of in above terms.
7. There shall be no order as to costs.
