While the matter was being argued, it has been brought to the notice of this Court by learned counsel for the petitioner that some enquiry has been conducted by the concerned Deputy Commissioner in which evidence has been recorded by the Deputy Commissioner concerned which is contrary to the record and inadvertently the petitioner while filing the present petition has not called in question the said enquiry. 2. Learned counsel for the petitioner, therefore, seeks withdrawal of the present petition with liberty to challenge the said enquiry report by way of filing fresh petition. 3.
