In the proceedings initiated by the petitioner before the Labour Court, Varanasi an award was made in his favour on 27.03.2024 in Adjudication Case No.18 of 2018, which was published in the official gazette on 07.05.2024. 2. It is argued by counsel for the petitioner that the aforesaid award has not yet been complied with. Counsel for the petitioner also placed reliance upon a letter dated 07.10.2024 written by the Deputy Labour Commissioner, U.P. Varanasi to the respondents no.4 & 5, copy of which is appended as annexure-2 to the writ petition. 3. In this view of the matter, a prayer has been made to direct the respondent no.2 namely Deputy Labour Commissioner, Natiemali, Varanasi to do the needful for compliance of award dated 27.03.2024. 4. Heard learned counsel for the parties and peruse the records. 5. In view of the order proposed to be passed herein, no useful purpose would be served by putting the respondents no.4 & 5 to notice and keeping this petition pending before this Court. However, in case respondents no.4 & 5 feels aggrieved by the order their right to seek modification/variation of the order is being kept reserved. 6. In view of the same, present writ petition is disposed of directing the respondent no.2 namely Deputy Labour Commissioner, Natiemali, Varanasi to initiate the proceedings for compliance of award dated 27.03.2024 as stated above most expeditiously and positively within a period of three months from the date of receipt of certified copy of this order unless there is no legal impediment.
