1. Mr. D.K. Sharma, learned senior counsel assisted by Mr. Nivesh Bahuguna, learned counsel for the applicant.

3. The present applicant ‘Waseem Khan’ is praying for regular bail in relation to First Information Report dated 04.04.2025 bearing FIR No. 03 of 2025 P.S. Baluwakot District Pithoragarh, which was lodged against four persons for the offences punishable under Sections 179 r/w Section 180 of BNS, 2023.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated, which is evident from the fact that the applicant is not named in the FIR and he has been implicated only on the basis of the statement of other co-accused Aasif. He further submits that recovery of only 2000 fake currency has been shown from the present applicant and furthermore two other co-accused Sameer Ul Rahman and Shoaib were enlarged on bail by this court.
5. Apart from this, he submits that the applicant have no previous criminal history.
6. On the other side, learned State counsel have not disputed this fact that the other co- accused have already been enlarged on bail, therefore, this case appears to be a case of parity.
7. After hearing the arguments of learned counsel for the parties and further taking into
consideration that the other co-accused have already been enlarged on bail and the role of the applicant is almost identical, therefore the applicant deserves for bail.
8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.
9. Let the applicant ‘Waseem Khan’ be released
2025:UHC:4357 on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
