THIS PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. CONCILIATION ORDER This Criminal revision petition is filed by the petitioner/accused praying to set aside the judgment dated 16.09.2023 passed in Crl.A.No.2695/2019 by the LII Addl. City Civil And Session Judge, Bengaluru (CCH-53) confirming the Judgment dated 26.11.2019 passed in CC No.25479/2016 by the VI Addl. Judge of Small Causes Court and ACMM, Bengaluru City and to acquit her by allowing this revision petition. 3 2. Sri.Shivareddy K.N., and Sri.Venugopal M.A., learned counsel appearing for the petitioner and the respondent respectively submit that after detailed discussions, the parties have arrived at a settlement and have filed a joint memo. The joint memo reads as under: "The CRL.RP. No.1651/2023 filed against the order passed in CRL.A.NO. 2695/2019 dated 16.09.2023 by the LII Addl. CITY CIVIL AND SESSION JUDGE, BENGALURU. Confirming the Judgment 26.11.2019 passed in CC No.25479/2016 by the VI Addl. Judge of Small causes Court and ACMM, BENGALURU. Now by the intervention of the well wishers of the parties the matter has been settled between the parties on the following terms and the same may kindly be as under. The Petitioner and the Respondents respectfully submit as under:- 1. At the instances of well wishers and friends of the Petitioner and Respondent, the Petitioner and the Respondent above named wants to settle the matter amicable. 2. The Respondent has presented the instant Complaint against the Petitioner Under Section 200 of Cr.P.CR/with 138 of NI Act for dishounour of Cheque amount of Rs.8,00,000/- and the same has been registered in CC No.25479/2016 on the file of VI Addl. Judge of Small causes Court and ACMM, BENGALURU and the same was allowed on 26.11.2019 convicting the accused for the above said offence and as against the said order the petitioner herein preferred an appeal in Crl Appeal No.2695/2019 on the file LII Addl. CITY CIVIL AND SESSION JUDGE, BENGALURU and the has been dismissed 16.09.2023, confirming the order of conviction passed by the court below, hence, the petitioner before the Hon'ble court by challenging the above said impugned orders in the said case. 3. The petitioner submit that the trial court convicted petitioner under section 138 of NI Act and sentence to pay total fine of Rs.8,55,000/- in 4 CC No.25479/2016 and the same was confirmed in Crl. A.No.2695/2019. 4. The Petitioner and Respondent jointly agreed for the settlement that the Petitioner has agreed to pay a sum of Rs.6,50,000/-(Rupees Six Lakhs Fifty Thousand Only) to the respondent in full and final settlement and the respondent has agreed to receive the same as following manner. a. Rs.2,50,000/- on or before 20.02.2026 b. Rs.2,00,000/- on or before 20.03.2026 c. Rs.2,00,000/- on or before 20.04.2026 The petitioner to deposit the said amount to the A/c 165401000015571, IFSC:IOBA0001654 AT INDIAN OVERSEAS BANK BOMMANAHALLI BRANCH. If the petitioner failed to comply the payment as agreed the respondent is at Liberty to initiate the recovery amount of Rs.8,55,000/- in accordance of law. Wherefore, the petitioner and respondent above named parties respectfully prays that this Hon'ble Court be pleased to pass a judgment on the above terms and conditions by acquitting the accused/petitioner in the above case. Hence the parties have compromised in terms of the above. The parties to this petition have set their hands to this settlement before the Lok Adalat in the presence of Conciliators on this 13.12.2025 at Bengaluru Bench." 3. In view of the above, the judgment dated 16.09.2023 passed by the LII Additional City Civil & Sessions Judge, Bengaluru (CCH-53) in Crl.A.No.2695/2019 confirming the judgment dated 26.11.2019 passed by the 5 VI Additional Judge Court Small Causes & ACMM, Bangalore City in C.C.No.25479/2016 are hereby set aside and the petitioner is acquitted from the alleged offences.
