Mr. Karan Singh Dugtal, learned counsel for the applicant. 2. Mr. Sandeep Sharma, learned A.G.A. for the State. 3. The present applicant ‘Surendra Singh Lawal’ is praying for regular bail in relation to First Information Report dated 28.04.2025 bearing FIR No. 0014 of 2025 P.S. Dharchula District Pithoragarh, wherein, the present applicant has been implicated for the offences punishable under Section 8/20 r/w Section 60 of NDPS Act. 4. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and furthermore the alleged contraband of charas, which is shown to be recovered from the present applicant is below a commercial quantity i.e. 806 gms. 5. It is submitted in paragraph 22 of the bail application that the applicant have no previous criminal history. 6. On the other side, learned State counsel submits that the alleged contraband, which is shown to be recovered from the present applicant is below a commercial quantity, however, about criminal history he has submitted that this fact is being verified. 7. Be that as it may admittedly the alleged contrabad, which is shown to be recovered from the present applicant is below a commercial quantity and furthermore the specific statement has been given in paragraph 22 of the bail application that the applicant have no previous criminal history, therefore, in view of the statement as given in paragraph 22, this court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Surendra Singh Lawal’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the 2025:UHC:4356 satisfaction of the court concerned. 10. It is made clear that if this fact is found to be false that the applicant have no previous criminal history then immediately the prosecution is directed to apprise this court.
