The petitioner has been made accused in connection with Daily Market P.S. Case No. 46 of 2018, arising out S.T. No.100239 of 2019 for the offences registered under sections 147, 148, 149, 302 of the Indian Penal Code and Sections 25(1-B)A/26/27/35 of the Arms Act, pending in the court of learned Additional Judicial Commissioner-VII, Ranchi. On 04.11.2018, son of the informant Sonu Imroz was shot dead by the named accused persons near Daily Market Main Road Taxi stand. There is specific allegation against the petitioner had also fired upon the deceased. Learned counsel appearing on behalf of the petitioner submitted that after investigation police had submitted final form against the petitioner. It was further submitted that however, on the basis of statement of the witnesses that the petitioner had also shot the deceased, he was arraigned under Section 319 of the Cr.P.C. and was taken into custody. Learned A.P.P. has opposed the prayer for bail and submitted that bail application of several co-accused persons was rejected by this Court earlier. It was further submitted that some of the co- accused, who had faced separate trial, have been convicted in this case. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected. (Ambuj Nath, J.) Jay/-
