04.12.2025. 32 Ct.No.24. as WPA 878 of 2025 Jalab Sk. & Ors. Vs. State of West Bengal & Ors. Mr. Kamalesh Bhattacharya, Mr. Aninda Bhattacharya. …for the Petitioners. Mr. K. J. Yusuf, Ld. A.G.P., Mr. Parikshit Goswami. …for the State. Mr. Sakya Sen, Ld. Sr. Adv. (VC), Mr. Sunil Gupta, Mr. Hasibul Islam. …for the Respondent Nos.3 to 8. 1. The petitioners are aggrieved by a notice of January 6, 2025 calling for a e-tender for the ferry service at Jalalpur Ferry Ghat plying between Berhampore and Beldanga. 2. The petitioners are also aggrieved by the fact that the infrastructure facilities in the precinct of the ferry ghat are not amenable for being used in any manner. Hence, e- tender notice ought to be set aside. The petitioner has, however, not participated in the e-tender. 3. Mr. Sen, learned Senior Advocate appearing for the Zilla Parishad submits that pursuant to the order of this Hon’ble Court of January 2, 2025, the Zilla Parishad has started the work and has progressed substantially. He further submits that the same would be completed over a period of time. 2 4. Since the petitioner has not participated in the e- tender process, the question of stay of the e-tender notice or ultimate cancellation thereof does not arise. 5. In these circumstances aforestated, the writ petition fails and is, accordingly, dismissed. 6. There shall, however, be no order as to costs. 7. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Reetobroto Kumar Mitra, J.)
