23.01.2025 Ms. Solemwon Ramson, learned counsel, appears for the petitioners. Mr. Kh. Samarjit, learned DSGI, appears for respondent No. 4; and Mr. Lungmi Ragui, learned counsel, appears for respondent Nos. 5 & 6. Respondent No. 4 has filed affidavit dated 05.06.2023 stating in para 5 therein that that pursuant to the direction passed by this Court in the writ petition, Assam Rifles have requested the Deputy Commissioner, Ukhrul, to provide the required document, i.e., (a) Patta/Dag Chitha of land, (b) Sketch of land, (c) Calculation sheet to proceed and in response thereto, the land ownership certificate and No Objection Certificate for 4(four) petitioners out of 5(five) have been furnished, however, Patta/Dag Chitha, Sketch of land in the name of the petitioners and calculation sheet have not been provided and relevant documents along with details of compensation are still awaited from the State, more particularly, the Deputy Commissioner, Ukhrul District. Mr. Kh. Samarjit, learned DSGI appearing for respondent No. 4, fairly states that the compensation amount has already been sanctioned and once the report has been received from the State authority, the said amount will be paid to the petitioner. Mr. Lungmi Ragui, learned counsel appearing for respondent Nos. 5 & 6, submits that the Deputy Commissioner, Ukhrul, has intimated the petitioners to ascertain the date and year of the occupation of the land by Assam Rifles and to furnish relevant documents for considering the claim of the petitioners for payment of compensation. In response to the aforesaid statement, Ms. Solemwon Ramson,
learned counsel appearing for the petitioners, submit that she received the communication dated 28.10.2024 issued by the Deputy Commissioner, Ukhrul, only today and in such circumstances, learned counsel for the petitioners, seeks four weeks’ time to submit the relevant documents to the Deputy Commissioner, Ukhrul. In view of the above submission, the petitioners shall submit the relevant documents to the Deputy Commissioner within a period four weeks from today and thereafter, the respondents has to pass orders in the light of the directions issued by this Court in the writ petition without any further delay. In such circumstances, the present contempt petition cannot be entertained at this stage and the same is accordingly closed. If there is any delay on the part of the respondents to comply with the said directions, it is always open to the petitioner to file a fresh contempt petition.
