(Oral) Since it is apparent from the pleadings adduced on record by the respective parties that the petitioner has remained posted at present place of posting for more than five years, this Court sees no reason to interfere with the impugned transfer order, as such, same is upheld. However, petitioner is permitted to file representation before the competent authority for his adjustment at nearby place on account of adverse family circumstances as were apprised to this Court during the proceedings of the case. Representation, if any, filed within a week, shall be considered by the competent authority within ten days. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass a speaking order thereupon taking note of adverse family - 2 - circumstances of the petitioner. Liberty is reserved to the petitioner to file appropriate proceedings in appropriate court of law, if he still remains aggrieved. Pending applications, if any, also stand disposed of.
