S. No. 74 Regular Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR
CCP(S) No. 145/2024 Abdul Rashid Dar and Ors. …Appellant/Petitioner(s) Through: Mr. F.A. Bhat, Advocate Vs. Deeraj Gupta and Ors. ...Respondent(s) Through: Ms. Rekha Wangnoo,GA CORAM:
HON’BLE MR JUSTICE VINOD CHATTERJI KOUL, JUDGE
O R D E R 19.05.2025 Petitioner filed a writ petition asking the respondents to regularize their services and also to grant retrospective effect from the date they had completed seven years i.e., 1992-2000 in terms of SRO-64 of 1994 when this petition was filed, after the objections were filed by the respondents this petition came to be disposed of with the direction to the respondents to consider the claim of the petitioner for regularization of their service in accordance with the SRO-64 of 1994 or any other scheme invoked within a period of two months from the date certified copy of this order is served upon them. Compliance report has been filed wherein respondents submit that case of the petitioner was considered in compliance to the judgment passed by this Court and vide Government order no. 41-JK (FST) of 2025 dated 21.02.2025, where a claim of the petitioners was rejected. It appears that even the petitioner submits that the said order has not been quashed in consonance with the provisions of law. Since the petitioners claim was with regard to the regularization in the Forest Department against the substantive post on the ground that they were appointed as Daily Wagers and are entitled to regularization in terms of SRO-64 of 1994. In terms of judgment they have considered and in case petitioner feels aggrieved of the said order of consideration and seeksregularization as in the Department of Forest against a substantive post he may take recourse of the remedy available under law. Therefore, this contempt is disposed of.
