1. Mr. Manoj Bhatt, learned counsel for the applicant.
2. Mr. Siddharath Bisht, learned AGA for the State.

The present applicant “Shri Kashif, son of Shri Sakeel” is praying for bail in relation to First Information Report dated 01.02.2025 bearing FIR No. 036 of 2025, Police Station – Kichha, District – Udham Singh Nagar wherein present applicant has been implicated for the offences punishable under Section 363, 376 IPC and under Section 3 / 4 of the POCSO Act.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and in fact, as per statement of the victim, she knows the applicant for the last one year and there is delay of 1 ½ years in lodging the FIR and with some ulterior motive and purposes, present FIR has been lodged and applicant has been implicated and in this particular case, charge sheet has already been filed on 28.03.2025 and as such, at this juncture, there is no need of custodial interrogation of the applicant and applicant has no previous criminal history and applicant is languishing in jail since 28.03.2025.
5. On the other side, Mr. Siddharath Bisht, learned AGA have vehemently opposed the bail application, by submitting that medical report supports the prosecution case and furthermore, victim in her statement supported the prosecution case.
6. After hearing the arguments of learned counsel for the parties and after gone through the contents of the FIR and charge sheet, this Court is of the view that the applicant does not deserve for bail.
7. Accordingly, bail application is rejected.
