The present Writ Petition has been filed under Article 226 of the Constitution of India with the following prayers:- “(i) A writ, order or direction in the nature of certiorari to quash the impugned orders dated 13.08.2019 (Annexure no. 1) passed by the respondent no. 3 whereby the salary of the petitioner has been re-fixed/re- determined and reduced from the grade pay of Rs. 5400/- to 4200/- per month. (ii) A writ, order or direction in the nature of certiorari to quash the impugned orders dated 03.04.2021 (Annexure no. 2) passed by the Managing Director of the Corporation whereby the subordinate officers are directed to initiate recovery proceeding against the Petitioner along with other employees. 1 2025:UHC:3743 (iii) A writ, order or direction in the nature of mandamus directing the respondents to consider the case of the Petitioner to grant him the Grade Pay of Rs. 5400/- for the post of Logging Officer by giving benefit of two years of service done on D. L. basis. (iv) A writ, order or direction in the nature of mandamus directing the respondents not to initiate any recovery in pursuance to order dated 03.04.2021. (v) Issue any other writ, order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case. (vi) Award cost of the Petition to the present Petitioner.” 2. Heard Mr. Krishan Mohan Joshi, learned counsel holding brief of Mr. Yogesh Pant, learned counsel for the petitioner, Mr. B.S. Koranga, learned Brief Holder for the respondent nos.1 & 2 and Mr. Rajesh Sharma, learned counsel for the respondent nos.3 & 4. 3. Both the parties submitted that the present matter is covered by the judgment dated 12.02.2025, passed by the Co-ordinate Bench of this Court in Writ Petition (S/S) No.446 of 2020, “Lalit Chandra Tiwari and Others Vs. State of Uttarakhand and Others” and Batch. 4.
