The petitioner claims that he should be given gratuity from the date, he joined as daily wager/casual worker. Heard learned counsel for the parties and perused the record. Learned counsel for the petitioner would submit that in order to claim gratuity from the date, the petitioner joined as casual labour or daily wager, he has already given a representation, which is Annexure 5 to the respondent. Therefore, the respondent may be directed to decide the representation, in accordance with law within a stipulated period. Learned Senior Counsel for the respondent would submit that the representation of the petitioner (Annexure 5) may be decided within a period of six weeks from the date of production of certified copy of the order. The Court takes on record the statement made by learned Senior Counsel for the respondent. The writ petition is disposed of with the direction to the respondent to decide the representation of the petitioner (Annexure 5), in accordance with law, within a period of six weeks.
