Learned counsel for the petitioner submits that he has come to the Court with limited prayer that he has been transferred vide order dated 15.1.2025, however, till date, he has not been relieved by the respondent No.2 to join at the transferred place and therefore, respondent No.2 be directed to relieve the petitioner. 2. On the other hand, learned State counsel, who appears on advance copy, submits that he has sought instructions, according to which the NISHA DUBEY Digitally signed by NISHA DUBEY Page No.2 petitioner could not be relieved as the person namely Roshan Lal Kaiwartya, who has been transferred in place of petitioner has obtained an order of stay from this Court to the effect that till decision on his representation against his transfer, the impugned order shall be kept in abeyance, and therefore, petitioner, who is posted in scheduled tribe area, could not be relieved. 3. Considering the aforementioned facts of this case, respondents are directed to relieve the petitioner in compliance of the transfer order dated 15.1.2025 within a period of six weeks from today and shall also make endeavours to pass appropriate orders in respect of Roshan Lal Kaiwartya, as per order dated 23.1.2025 passed in WPS No.604/2025. 4.
