Mr. Shakti Saurabh Purohit, Advocate holding brief of Mr. Piyush Garg, Advocate for respondent no.5. 4. This writ petition has been filed by the petitioner seeking the following reliefs:- “I. Issue a writ, order or direction in the nature of mandamus commanding the respondent no.3 to produce the progress report of FIR No.548 of 2024 under Section 308(2), 351(2), 352, 74 and 77 of B.N.S. 2023, Police Station Japur, District Udham Singh Nagar. II. Issue a writ, order or direction in the nature of mandamus commanding the no.1&2 to transfer the investigation of FIR No.548 of 2024 under section 308 (2), 351(2), 352, 74 and 77 of B.N.S. 2023, Police Station Japur, District Udham Singh Nagar to CBI or any other competent authority as deem fit and proper by this Hon’ble Court to ensure that the petitioner receive a fair and impartial investigation free from any undue influence or pressure.” 5. A Co-ordinate Bench of this Court on 23.05.2025 directed the respondent to file progress report as also counter affidavit within four weeks’ failing which S.H.O. concerned shall appear before this Court. 6. Although the order dated 23.05.2025 was a conditional order for the S.H.O. to appear in-person before this Court on 12.06.2025, in the eventuality of failure of the State in filing the progress report and also the counter affidavit. 7. Today Ms. Ruchita Chauhan – Sub Inspector 2 /Investigating Officer of the case is present and the progress report is submitted by her before this Court through State Counsel, which is taken on record. 8. As per progress report the investigation has been completed and charge sheet has been submitted against respondent no.4-Ajay under Sections 351(2), 352 and 74 of B.N.S., 2023. 9. In view of the progress report submitted by the Investigating Officer before this Court nothing survives in the present writ petition and the same is hereby closed. 10. In view of the development made and on the basis of investigation the second prayer made by counsel for the petitioner is not to be interfered with. (Pankaj Purohit, J.) 12.06.2025 SK
