ORAL ORDER
Petitioner is the sole accused in Crime No.192/2024 of Ullal Police Station, Mangaluru City, registered for the offence punishable under Sections 126(2), 352, 109(1), 351(2) of the BNS, 2023.
2. Heard the learned counsel appearing for petitioner and the learned HCGP for respondent-State. Perused the material on record.
3. The incident has taken place on 18.10.2024 at about 3:15 a.m, wherein it is alleged that the petitioner has assaulted the complainant with talwar on his head and other parts of the body, with an intention to commit his murder.

4. The learned HCGP has contended that, petitioner is a rowdy sheeter, involved in several criminal cases and seven of those cases are pending. He contended, CWs.2 to 6 are the eyewitnesses and after the arrest of petitioner, bloodstained weapon and his pant are recovered and a motorcycle was also seized. Therefore, sought to dismiss the petition.
5. The learned counsel for petitioner contended that, petitioner has been falsely implicated in this case as well in previous cases. He contended, petitioner has been acquitted in 16 cases, which are registered against him. He contended that the victim has not sustained any life threatening injuries as alleged. Petitioner is in judicial custody since 19.10.2024 and he is ready and willing to abide by any conditions. Accordingly, sought to allow the petition.
6. I have perused the wound certificate of the injured / CW.1. He has sustained 6 injuries, out of which injury Nos.4 and 6 are said to be grievous injuries. However, the

said injuries are on right index finger and on the nasal bone. Petitioner was arrested on 19.10.2024. He is in judicial custody since then. Investigation is completed and charge sheet has been filed. The apprehension of prosecution can be taken care of by imposing stringent conditions. Hence, the following:
ORDER
Petition is allowed.
Petitioner / accused in Crime No.192/2024 of Ullal Police Station, Mangaluru City (S.C.No.43/2025 pending on the file of the learned II Additional District and Sessions Judge, D.K., Mangaluru) shall be released on bail subject to following conditions: a) Petitioner shall execute a personal bond in a sum of Rs.1,00,000/- (Rupees One Lakh Only) with two sureties for likesum to the satisfaction of the jurisdictional Court; b) He shall furnish proof of his residential address and shall inform the

Investigating Officer/Court, if there is any change in the address. c) He shall mark his attendance at Ullal Police Station, Mangaluru City on every Sunday between 11:00 a.m. and 1:00 p.m., for a period of six months. d) He shall not indulge himself in committing any offence. e) He shall not leave the jurisdiction of trial Court without prior permission of the learned Sessions Judge. f) He shall not tamper with the prosecution witnesses either directly or indirectly. g) He shall appear before the trial Court on all dates of hearing without fail.
If any of the conditions are violated, the prosecution is at liberty to seek cancellation of bail.
