Heard learned counsel for the applicant, learned AGA for the State-respondents and perused the record. 2. From the perusal of the order-sheet, it transpires that notice has already been served upon the informant but no one appears on behalf of the informant. 3. This bail application has been moved on behalf of accused- applicant Ratan Singh @ Kala seeking enlargement on bail in Case Crime No.71 of 2025, under Sections 115(2), 126(2), 140(4) B.N.S., 3/4(2) POCSO Act and 3(2)5 of SC/ST Act, Police Station- Usawan, District- Budaun. 4. Learned counsel for the applicant submitted that applicant is innocent and has been falsely implicated in this case due to ulterior motive. It is submitted that the injured sustained injuries accidentally. It is argued that the applicant has no criminal history and is languishing in jail since 7.5.2025. Hence bail has been prayed for. 5. Learned A.G.A. has vehemently opposed the submission of learned counsel for the applicant and submits that accused applicant is named in the FIR and has committed unnatural sex against the victim Ashwini Kumar aged about 13 years. As per the medical report, the age of the victim is 13 years. The victim in his statement recorded under Section 183 B.N.S.S. has stated that the accused has committed unnatural sex with him and thereafter he became ill. The age of the accused is 20 years while age of the victim is 13-14 years. As per the medical report, the victim has sustained two injuries on private parts which are quoted below:- "1. Multiple abrasion present on peri anal region all around anal verge. 2. Skin tear of 0.5 cm length skin deep over anal region 6O' clock position anal verge." 6. Thus, medical evidence/injury report corroborates the statement of Versus Counsel for Applicant(s) : Santosh Kumar Yadav Counsel for Opposite Party(s) : G.A. Ratan Singh Alias Kala .....Applicant(s) State Of U.P. And 3 Others .....Opposite Party(s) victim/injured. Very serious allegation has been levelled against the accused. 7. Without expressing any opinion on merits of the case and considering the submissions advanced, the nature and gravity of the accusation, I find no good ground to grant bail to the applicant in the aforesaid case, at this stage. 8.
