Present Mr. I. Somorjit, learned counsel for the petitioner and Mrs. RK. Emily, learned Dy. GA for the State respondent. The matter is already settled in mediation on 14.07.2025 and the terms of settlement is reproduced herein below:-
“TERMS OF SETTLEMENT 14-07-2025
The writ petition is put up before the Mediation as per the Notification dated 05-06-2025 issued by the Secretary, High Court Legal Service Committee, High Court of Manipur for conducting mediation. The petitioner has filed the said writ petition against the respondents for issuing a writ of mandamus or any other writ for directing the respondents to pay compensation to the tune of 20,00,000/- (twenty lacs) to the petitioner for causing disability due to electrocution as a result of negligence on the part of the respondents. The petitioner is represented by his parents namely T.S Ngaopuni (Father) and T.S Khuingaila (Mother) in presence of the witness S.P Joseph (Grandfather of the petitioner) and Moses Pao, Ld. Counsel for the petitioner. The respondent No.2 is represented by K. Nabakanta, G.M.
EC- III (MSPDCL) and Ms. Ambika L., DGM (Legal) (MSPDCL). The petitioner is also heard in person through video conference and he has identified both his parents who are present physically during the mediation. He has also given a Letter of Authority dated 05-07-2025 authorising his parents to represent him in the said mediation. A copy of the said Letter of Authority is shown to him and he has testified that he has given the said OINAM THOIBA MEITEI Digitally signed by OINAM THOIBA MEITEI Date: 2025.07.17 15:34:13 +05'30'
Letter of Authority and the signature appearing in the said Letter of Authority is his signature. During the process of mediation, the parties have come to an amicable Settlement and they have agreed to reduce into writing the terms and conditions of their settlement. 1. That, it is agreed between the parties that the respondent No. 2 shall pay a sum of Rs. 6,00,000/- (Rupees six lacs only) as full and final compensation amount to the petitioner within a month from today i.e the 14th July, 2025.
The petitioner has also agreed to withdraw all the allegations made against the respondents and assures that no further claim, demand or legal action shall be initiated against the respondents regarding the said incident. 2. That, the compensation amount shall be deposited to the saving account of the petitioner maintained at the SBI, Senapati Branch i. e A/C No. 40003149949, IFSC Code- SBIN0004522 by the respondent No.2 within a month. 3. That, the petitioner will withdraw the above mentioned writ petition and all disputes and grievances stand fully resolved in view of the compensation amount of 6 lacs being agreed to be paid to the petitioner by the respondent no.2
4. Having settled as per the terms and conditions set forth herein, the parties have mutually agreed to dispose the present writ petition. The above terms and conditions are read and explained to the parties and they have put their respective signature in their sound state of mind any without any inducement and after knowing the contents of the settlement. Hence, the mediation is hereby settled. Parties are to appear before the Hon'ble High Court.”
Accordingly, the present W.P. (C) No. 227 of 2021 is disposed of in terms of settlement in mediation. JUDGE
