CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH
----- For the Petitioner : Md. Ayub Ansari, Advocate For the State
: Mr. Rakesh Kumar Sinha, A.P.P.
--- 02/19.03.2025
Heard the parties.
The petitioner has been made accused in connection with S.T. No. 465 of 2024 arising out of Dumri P.S. Case No. 25 of 2024, for the offences registered under Sections 302/201 of the Indian Penal Code, pending in the court of learned District & Additional Sessions Judge-IV, Giridih. On 23.02.2024, mutilated dead body of an unknown person was found lying behind Progressive Public School near Pipradih, Gorwa Rakhwa. During the course of investigation, petitioner was apprehended and, on his confession, murder weapon was recovered.
Learned counsel for the petitioner submitted that wife of the petitioner Anju Devi who is also accused in this case, has been granted bail by this Court earlier. Learned A.P.P. has opposed the prayer for bail and submitted that murder weapon was recovered on the basis of confession of both the petitioner and his wife. However, the confession of the petitioner was recorded at first point of time. In view of the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
