HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 21939 of 2025 Court No. - 39 HON'BLE ARINDAM SINHA, J. HON'BLE SATYA VEER SINGH, J. 1. Mr. Pradhumn Kumar Pandey, learned advocate appears on behalf of petitioner and submits, his client took her grievance against the insurance company to the District Consumer Disputes Redressal Commission. By order dated 21st June, 2023, the Commission rejected the petition. The order be interfered with. On query he submits, the insurance company appeared and its contention was accepted by the Commission. 2. Mr. Raj Mohan Upadhyay, learned advocate, Additional Chief Standing Counsel appears on behalf of respondent nos.1, 2 and 4. 3. Petitioner has alternative statutory remedy of approaching the State Commission. Mr. Pandey submits, present approach to the State Commission may be rejected on delay. We, however, think it fit that petitioner should first exhaust her statutory remedy and then approach the writ court, even if such remedy is exhausted and rejected on delay. In the circumstances, we do not think it necessary to direct issuance of notice on respondent no.3 (the insurance company). 4. The writ petition is dismissed as not maintainable. It will not prevent petitioner from approaching the State Commission as aforesaid. October 6, 2025 Salim Versus Counsel for Petitioner(s) : Pradhumn Kumar Pandey Counsel for Respondent(s) : C.S.C.
