Gurjeet Singh versus State of Himachal Pradesh Cr.MP No.465 of 2025 In Cr. Revision No.187 of 2011 [Disposed of Matter] 20.02.2025 Present: Mr. Arsh Chauhan, Advocate, for the petitioner. Mr. Dilip K. Sharma, Additional Advocate General, for the respondent- State. Petitioner-accused [Gurjeet Singh], has come up by way of instant application under Section 528 of BNSS, seeking extension of time for complying with the directions contained in Para 14 of the judgment dated 12.03.2024, passed by this Court in Criminal Revision No.187 of 2011, titled as Gurjeet Singh versus State of Himachal Pradesh, decided on 12.03.2024, directing the release of petitioner-accused after extending benefit of Probation of Offenders Act; subject to furnishing personal bond in the sum of Rs.50,000/- with two sureties in the like amount to the satisfaction of Learned Trial Court concerned and fulfillment of other conditions as contained in Judgment. 2. Now, in instant application, it is averred that the petitioner could not comply with the Judgment dated 12.03.2024, for the reason, that he was neither aware of passing of judgment nor was he informed by his Learned Counsel. In Para 5 of application, petitioner-applicant-accused has undertaken that he is ready and willing to comply with the judgment dated 12.03.2024 and shall execute his personal bond and surety bonds in case, the time is enlarged by this Court. 3. Upon listing of case, this Court is of the considered view, the averments in the application, which are supported by an affidavit, coupled with the undertaking furnished in Para 5 of instant application, this Court, allows the present application, so as to secure the ends of justice, in the following terms:- (i). Petitioner-applicant [Gurjeet Singh] is directed to comply with the directions contained in the judgment dated 12.03.2024 and to furnish personal and surety bonds in terms of judgment, within two weeks from today and not later than 10.03.2025. (ii). Upon furnishing the bonds, the consequential action, in terms of the judgment, be taken by the Learned Trial Court and all concerned.
