02/26.03.2025 Heard Dr. P.C. Sinha, learned counsel for the petitioner and Mr. Deepak Kumar Bharti, learned Spl. P.P, CBI.
The petitioner is an accused in connection with R.C. 06(A)/2017(D).
It has been alleged that the petitioner had impersonated one Sahdeo Prasad in the examination conducted by the DGMS for Mining Sirdar certificate and Sahdeo Prasad has been given the certificate for being successful in the examination. The petitioner and the other accused persons have caused a pecuniary gain to the tune of Rs.1.52 crores.
It has been submitted by learned counsel for the petitioner that though the petitioner was granted anticipatory bail earlier but since he could not fulfill the conditions for grant of anticipatory bail, he had surrendered and is in custody since
20.01.2025. It has further been submitted that the charge sheet has been submitted by the CBI.
Learned Spl.P.P, CBI has opposed the prayer for bail of the petitioner.
It appears that the petitioner had earlier moved for grant of anticipatory bail in A.B.A. No.10202 of 2021 which was granted vide order dated 11.01.2022 subject to the condition that the petitioner shall deposit an amount of Rs.19,00,000/- with the Director General of Mines Safety, Dhanbad without prejudice to his defence. However, as stated by learned counsel for the petitioner the petitioner could not deposit the said amount and ultimately had to surrender on 20.01.2025 from which date
-2- he is in judicial custody. Charge sheet has already been submitted by the CBI.
In view of the aforesaid therefore, the petitioner is
directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each, to the satisfaction of learned Special Judge, CBI cum Additional Sessions Judge, Dhanbad in connection with R.C. 06(A)/2017(D).
This application stands disposed of.
