This petition is filed by the wife under Section 24 Code of Civil Procedure against her husband with the following reliefs: (i) Pass appropriate order/s, direction/s to the transfer of Matrimonial Case in M.C.No.97/ 2025 pending on the file of Principal Senior Civil Judge, Bangalore Rural, Bangalore Rural District, to the Principal Senior Civil Judge, Holenarasipura, in the interest of justice and equity. (ii) Pass such other order/s as the Hon'ble Court deems fit in the circumstances of the facts of the case, in the interest of justice and equity. 4. Facts of the case are as under: 4.1 On account of strained matrimonial relationship, respondent- husband has filed a divorce petition before the Civil Judge, Senior Division, Bangalore Rural District in MC No.97/2025. Earlier reconciliation between parties was not - 4 - HC-KAR NC: 2025:KHC:50824 CP No. 122 of 2025 fruitful and the wife is now residing in Holenarasipura and discharging her job at Chennarayapatna and therefore she is unable to attend the Court at Bangalore for effective participation in the matrimonial case. 5. Since the learned counsel for the respondent is absent, this Court perused the material on record meticulously. 6. On such perusal of the material on record, it is noted that geographical distance and other difficulties expressed by the wife are no longer valid parameters for transfer of the pending case from Civil Judge, Senior Division, Bangalore Rural District to Court at Holenarasipura in view of the video conferencing facility. 7. Petitioner is permitted to effectively participate through video conference before the Court at Civil Judge, Senior Division, Bangalore Rural District in the pending matrimonial case and if any such application is filed by the wife, the same shall be allowed by the Civil Judge, Senior Division, Bangalore Rural District. 8.
