Instant writ petition has been filed by the petitioner under Article 227 of the Constitution of India, seeking direction to the learned Senior Civil Judge, Todaraising, District Tonk to execute the judgment and decree dated 03.07.2017 passed in Civil Suit No.28/1995 by the Civil Judge, Todaraising, District Tonk. 2. It is not in dispute that the execution proceedings to execute the judgment and decree dated 03.07.2017 are already sub judice, hence, with liberty to pursue such execution proceedings expeditiously, counsel for petitioner does not want to press this petition and seeks permission to withdraw the same. 3.
