It is not established from the prosecution story that applicant has instigated the deceased to commit suicide. The offence under Section 108 BNS is not attracted against the applicant. The offence under Section 108 BNS would attract against only co-accused Rizwan, who as per prosecution story, used to threaten the deceased by making telephonic call. The case of applicant is distinguishable from co-accused Rizwan. He submits that charge sheet in this case has already been filed before the Trial Court and the applicant is not required for any further interrogation. The applicant has no criminal antecedent and there is no likelihood of their fleeing from course of justice or tampering with evidence in case of release on bail. It is further submitted that on the similar footing the co-accused Kallu Alias Salman, Ashok Khan, Golu @ Imran, have been granted bail by the Court vide order dated 14.08.2025 passed in Criminal Misc.
