The review petitioner seeks review of the order dated 30.09.2024 passed in Cont No. 362/2024. 2. Learned Sr. Advocate for the applicant would submit that Municipal Corporation is currently under severe financial constraints therefore, it is not in a position to pay compensation to private respondents for acquiring the land for construction of road. He would further submit that there is already alternative road exists in the area, therefore, there is no need to acquire disputed land of respondent No. 12 and the corporation is intending to return the land of respondent No. 12 after removing temporary road constructed over the private land. 3 3. Learned counsel for the respondent No. 12 would submit that he has tried to construct wall on his own land, but the residents of the locality are objecting it, therefore, he is not able to utilise his land for so many years. 4. Considering the submission, the Corporation is directed to remove entire murrum and aggregate spread over the private land owned by respondent No. 12 within two months from the date of receipt of copy of the order. It is directed that the respondent No. 12 shall move an application to the Superintendent of Police who will provide police protection to him for maintaining law and order during the construction of the wall. He is also at liberty to claim damages caused by the action of the Corporation. 5. Copy of this order be forwarded to the Secretary, Urban Administration and Development Department, Raipur to see that the order is complied with in its letter and spirit ? 6.
