V/S
STATE OF HARYANA
...RESPONDENT
CORAM: HON’BLE MR. JUSTICE SANDEEP MOUDGIL Present: None for the petitioner.
Ms. Mayuri Lakhanpal, DAG, Haryana.
Ms. Pragyat Bhardwaj, Advocate for the complainant.
**** SANDEEP MOUDGIL, J. (ORAL)
1.
The jurisdiction of this Court has been invoked under Section 483 of BNSS seeking regular bail to the petitioner in case FIR No.206 dated 11.05.2020, under Sections 302, 201 (added later on), 120-B, 195, 34 deleted later on of BNS, 2023, registered at Police Station Sadar Ambala, District Ambala, Haryana.
2.
Learned State counsel submits that trial of the case is at fag end and out of 23 witnesses, 20 have been examined. Further, recovery of pillow and wire, with which, the deceased was strangulated has been effected from the petitioner, as such, he has played an active role in commission of crime.
3.
In view of the commission of offence under Section 302 of IPC, this Court is not inclined to grant bail to the petitioner, especially, after considering the fact that the trial is at the fag end and out of total 23, 20 witnesses stand examined.
4.
There is no representation on behalf of the petitioner. It appears that neither the petitioner nor his counsel is interested in pursuing the present petition.
5.
Under these circumstances, having left with no other option, the present petition stands dismissed for want of prosecution.
