ORAL ORDER Petitioner, being aggrieved by the registration of the case in Crime No.356/2024 at Mahalakshmipuram Police Station, Bengaluru has preferred this petition under Section 528 of BNSS, 2023, to quash the FIR/complaint. 2. Respondent No.2 herein set the law into motion alleging that she is working as a makeup Artist and the petitioner and her Associates were continuously calling her during night hours, abusing and threatening her and they

are troubling her by posting her edited videos and pictures on social media etc. 3. Petitioner and respondent No.2 are present before the Court. They are identified by their respective learned counsels. Respondent No.2/defacto complainant has filed an affidavit. Para Nos.1 to 3 of the said affidavit are extracted hereunder:
“1. I state that, FIR in Crime No.365/2024 for the offences punishable under section 351(2),352,77 of BNS, 2023 was registered by the Mahalakshmipura Police based on the first information lodged by me. 2. I state that, due to some misunderstanding about the facts & identity of the Petitioner, I had lodged the first information against the petitioner and with the intervention of the elders and well wishers, I have come to know that petitioner has not done any acts/offences alleged in first information and I do not want to prosecute this case against the petitioner. 3. I state that, we both have amicably sorted out our differences & misunderstanding in the guidance of the elders, friends & well-wishers. I

further state that, continuation of the criminal case would hinder the future endeavors & life of both of us and therefore, we have amicably settled the dispute between us.”

Respondent No.2, present before the Court would submit that due to some misunderstanding she lodged the FIR against the petitioner and she do not want to prosecute the case against the petitioner any further, as both of them have amicably sorted out the differences and misunderstanding. 5. The affidavit filed by respondent No.2 is placed on record. Respondent No.2/defacto complainant herself has come forward stating that she has lodged the FIR against the petitioner due to some misunderstanding and she has amicably sorted out the differences agaisnt the petitioner. The dispute is private in nature.
In view of the affidavit filed by respondent No.2/defacto complainant, no purpose will

be served in continuing the proceedings against the petitioner. Hence, the following:
ORDER Petition is allowed. The entire proceedings arising out of Crime No.356/2024 of Mahalakshmipuram Police Station insofar as the petitioner/accused No.1 is concerned is quashed. I.A.No.1/2025 is disposed of.
