Neutral Citation No. - 2025:AHC:111037-DB Court No. - 40 Case :- WRIT - C No. - 20891 of 2025 Petitioner :- M/S Abhay Pratap Singh Respondent :- State of U.P. and Another Counsel for Petitioner :- Dharmendra Kumar Tripathi,Praveen Chandra Mishra Counsel for Respondent :- Archit Mandhyan,C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioner, Sri Tejasvi Mishra, learned counsel for respondent no.2 and learned Standing counsel for the State. Sri Ishan Mehta, Advocate has appeared for the successive bidders. Petitioner is aggrieved by rejection of his technical bid. Bids have been invited for certain work by the respondents on 4.6.2025. The technical evaluation of bids is undertaken by the respondents. Petitioner's bid has been technically disqualified on account of various shortcomings. The shortcomings indicated include submission of a defective affidavit in support of the bid. Learned counsel for the respondents has invited our attention to the affidavit annexed alongwith the writ petition which indicates that the notarial affidavit was prepared on 20.5.2025, whereas the contract itself was advertised on 4.6.2025. We find substance in the respondents' contention that when the bids were invited on 4.6.2025 the notarial affidavits in pursuance of such bid could not have been prepared in the month of May. There are other shortcomings also pointed out in the petitioner's bid. Having examined the materials placed on record, we find substance in the decision taken by the authorities to technically disqualify the petitioner's bid. Writ petition is, accordingly, dismissed.
