THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1485 of 2025 ORDER:
The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A4 to grant anticipatory bail in connection with Crime No.18/2022 of Inavilli Police Station, East Godavari District. 2. Originally, the case was registered against the accused nos.1 and 2 for the offence punishable under Section 489-B r/w 34 IPC and the name of A3 was included and A3 was arrested. As the petitioner was under the impression that A3 confessed his name, he filed the present Criminal Petition for anticipatory bail. 3. Case of the prosecution in brief, is that, on 11.01.2022 at 5.00 pm at Magam Village, Sri Veera Bhadra Kirana and General Stores, Ainavilli Mandal, police, on credible information, searched the stores and found 20 Nos. of Rs.500/- fake currency notes and 30 Nos. of Rs.200/- fake currency notes, and arrested A1 and seized the fake currency notes and mobile phone. After that, on his confession, A2 and A3 were also arrested. 4. Heard. Perused the record. 2
5. Learned Assistant Public Prosecutor submits that so far, name of the petitioner is not involved in the F.I.R and he is not shown as an accused in this crime. 6. A perusal of the material available on record goes to show that the accusation is mainly directed against A1 and A2 and they were remanded to judicial custody, and during interrogation, A2 confessed the name of the A3 and hence A3 was arrested on 01.12.2024 after two years of registration of the crime. It is submitted by the learned counsel for the petitioner that A3 worked under the petitioner in his shop and when A3 committed theft of mobile phone of A4, A4 admonished him and removed him from job. Under the aforesaid circumstances, A3 gave false confession before the police against him to wreck vengeance. 7. As the learned Assistant Public Prosecutor submits that till now, the petitioner was not arrayed as an accused in the present crime and the name of the petitioner was not mentioned in the F.I.R. Therefore, this Court is of the view that the present Criminal Petition is premature and this Court is not inclined to entertain the present Criminal Petition, in the present circumstances. Accordingly, the Criminal Petition is dismissed.
