(Oral) On the last date of hearing, it has been submitted by learned counsel appearing for the parties that the matter has been settled.
2. In view of the settlement, petitioner had tendered Cheque bearing No.470051 for a sum of Rs.2,50,000/- to the learned vice counsel appearing for the respondent and the matter has been adjourned for making the remaining payment of the settled amount.
3. Today, learned counsel appearing for the petitioner has tendered the Cheque No.000021, issued a for 1 Whether reporters of Local Papers may be allowed to see the judgment?
( 2025:HHC:27089 ) a sum of Rs.2,50,000/- drawn at HDFC Bank, Branch at Shimla. This amount has been tendered as payment of the remaining amount, out of the settled amount of Rs.5,00,000/-. This amount has been received by learned counsel for the respondent, as the remaining payment of the settled amount.
4. In view of the settlement, learned counsel appearing for the respondent has stated at bar that the total amount of settlement has been received and now the respondent will withdraw the complaint, pending before the learned trial Court.
5. In view of settlement between the parties, learned counsel for the petitioner has submitted that the petitioner does not want to proceed further in the matter now and prayed that the present petition may kindly be dismissed, as not pressed, enabling the parties to make necessary statements before the learned trial Court, on the basis of the settlement.
6. Parties are bound by their undertakings as mentioned in the order.
7. Consequently, the present petition is dismissed as withdrawn, so also, the pending application if any.
