2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 319(2), 318(4), 338, 336(3), 340(2), 61(2), 3(5) of the B.N.S and under Sections 66(B) and 66(D) of the I.T. Act.
3. The prosecution case, in brief, is that on the basis of secret information received by the SHO, a raid was conducted in a garden where certain cyber criminals had assembled and were engaged in defrauding people. Five persons were arrested on the spot, who disclosed that they had been creating fake identities in the name of Dhani Finance to deceive the public, and data of several individuals was recovered from their possession. The petitioner is alleged to have fled from the place of occurrence
Patna High Court CR. MISC. No.62953 of 2025(2) dt.10-09-2025 2/2 and he has one criminal antecedent of a similar nature.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. He further submits that his name has transpired in the present case on the basis of confessional statement of the co- accused persons and he was not present at the spot.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and the fact that the petitioner has a criminal antecedent of similar nature, prayer for grant of anticipatory bail of the petitioner is rejected.
