ORAL ORDER
Aggrieved by the order passed in Crl.Misc.No.559/2024 dated 14.08.2025 by I Additional Principal Judge, Family Court, Mysuru, whereby the Family Court had rejected the application filed under Section 94 of the BNSS Act. 2. For the sake of convenience, the parties are referred to as husband and wife. 3. Wife has filed an application under Section 94 of the BNSS Act seeking issuance of direction to the Accounts officer, Pension Department, University of Mysuru to produce the pension details of the respondent/husband, retirement benefit of the husband, Service Register and recent pension extract/pension slip before the Family Court, which came to be dismissed. 4. The Family Court observing that the husband has produced recent SBI Bank account to convince the Court that he is regularly receiving the pension amount from the University of Mysuru and even for the month of June, 2025 and July, 2025, he received pension amount from the University of

Mysuru apart from his SBI Bank regarding credit of retirement benefits remitted to his bank account. When such being the case, once again summoning the documents from the Accounts Officer of the University of Mysuru belong to the husband does not arise and its hold no case. The Family Court also observed that the husband has already produced the documents before the Family Court in response to the notice taken by the wife and the same is available in the case file. The documents summoned by the wife are not required for adjudication of the case and accordingly, the application is dismissed. 5. When this matter came up on the last occasion, this Court had directed the husband to file an affidavit before this Court showing what is the pension and what are the retirement benefit he has received. 6. The husband has filed the affidavit. It is stated that he was working as Attender in the University of Mysuru and he retired from the service on
30.09.2019. A sum of Rs.12,43,191/- is credited to his account on 15.10.2019 towards Death-cum-Retirement Gratuity (DCRG) and a sum of Rs.4,21,640/- is credited on 24.01.2020 towards Leave

Encashment.
Total sum of Rs.16,64,831/- was received by him as retirement benefit and pursuant to the retirement, initially pension amount which is credited to his account was Rs.14,765/- and presently, he is receiving a sum of Rs.27,398/- per month as pension. The pension payment order dated 25.09.2019 and the Bank statement were produced before the Family Court and the same are also produced before this Court as Annexures-E and F.

Considering the affidavit that is filed before this Court and in the light of the observations that are made by the Family Court, this Court is of the view that the application filed by the petitioner/wife is devoid of merits and no interference is called for with the order impugned. Accordingly, this Court is passing the following:
ORDER
i) The writ petition is dismissed.
ii) All pending IAs, if any, shall stand closed.
