22/12/2025 D/L – 55 Court No.28 S. Kundu Rejected C.R.M.(A) 4041 of 2025
In Re: An application for anticipatory bail under Section 482 of the BNSS,
2023.
In connection with Harischandrapur P.S case no. 966 of 2025 dated 7/9/2025 under sections 329(4)/115(2)/117(2)/74/303(2)/89/3(5) of the BNS. In the matter of: Dilera Khatun & Ors. ...Petitioners. Mr. Parvej Anam …for the petitioners. Mr. Shiladitya Banerjee Ms. Srikekha Chattopadhyay …for the State.
1. Heard the learned counsels for the parties.
2. Perused the case diary.
3. The prosecution case is that the present petitioners, along with some others out of previous grudge, came to the house of the victim, disrobed her, molested and assaulted her, causing miscarriage of her foetus. The State has placed reliance on statements of the victim and neighbours as well as the discharge certificate supporting the prosecution case.
4. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioners.
5. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
