1. Impugned in this petition filed under Article 226 of the Constitution of India, is an interim order dated 2nd April, 2025, passed by the learned Central Administrative Tribunal (CAT), Bench, Srinagar (the Tribunal) in OA No. 288/2025, titled “Abdul Rashid Mir Vs. Food Civil Supplies & Consumer Affairs”, whereby the Tribunal, while entertaining the OA of the petitioner and issuing notice to the respondents, fixed the matter for filing of reply on 05.05.2025.
2. Petitioner is aggrieved of the order to the extent it declines an ex- parte interim stay of the recovery.
3. Having heard learned counsel for the parties and perused the impugned order on record, we are of the considered opinion that the prayer of the petitioner for grant of interim stay against the recovery has not been rejected, but has been kept for consideration after the reply is filed by the respondents. cause for the petitioner to invoke the extraordinary writ jurisdiction of this Court.
4. We are, therefore, not inclined to entertain this petition and the same is accordingly, disposed of with a request to the Tribunal to consider the application of the petitioner for interim relief on 05.05.2025, even if the respondents fail to file response.
