3. The detenu had been convicted for the offences punishable under Sections 302, 341 and 307 of IPC in S.C.No.178/2015 by the LXVI Additional City Civil and Sessions Judge, Bengaluru and sentenced on 05.06.2018 with highest of the sentence being imprisonment for life and fine. The detenu, in all, has been incarcerated for a period of 10 years, 5 months, 20 days as on 15.11.2025 and has been on parole for a period of 7 months.
4. The present application has been filed by the mother of the detenu seeking for emergency parole on account of the death of the elder sister of the detenu namely Lakshmi who expired on 12.11.2025. The emergency parole has been sought for to enable the detenu to attend the ceremonies and discharge his due obligations as the brother of the deceased. Death of a near relative being one of the grounds for emergency parole.

5. Taking into consideration that the detenu had already been released on parole on earlier occasions and there is no complaint against the detenu when so released, I am of the considered opinion that the present application for emergency parole would have to be allowed, more so, when the death of the sister of the detenu has been confirmed by learned AGA upon due verification.
6. In that view of the matter, I pass the following:
ORDER i. The writ petition is allowed. ii. Respondent No.2-the Superintendent, Open Jail, Devanahalli, is directed to release the detenu-Vasudeva @ Vasu-CTP No.1101,on emergency parole for a period of 30 days commencing from 19.11.2025, subject to the following conditions. a) The prisoner (CTP No.1101) shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period
